How do you get planning permission etc
I know some people who have a small house with a huge garden in an exclusive area. Very very posh. THe garden is probably the largest in the road (a long road).
They are thinking of selling the house precisely because they are fed up of having a large garden.
I was tinking that they could get design an extension and then get outline planning permission (without effecting the development) and then sell the house at a higher price.
Is this feasible and has anyone ever done this?

yes - its easy enough. Start by getting quotes for the work, a lot of building companies will quote for the full thing - including plans and submitting for permission.
An alternative option would be to get a draughtsman to draw up the plans for you and apply for planning permission on your behalf. Once you get approval, you can then get quotes from building firms. There are actually two stages to plans (in Scotland at least) the initial outline plans that you get permission for and the the actual building plans that the builders build from.
Have just been though all of this myself - but we finally decided to move instead of go thorugh the months of building work.

To be honest i wouldn't bother with that (what if they got turned down ?)
Im selling a 2 bed end terrace with a lot of 'space' to the side
I asked how much would it help if id got the 'planning permission etc'
Esate agent said they would put scope to extend subject to planning permission
Did get two builders who saw it, i believe they went down town hall etc or what ever they do and got turned down :sad: Think a car parking lot/ works garage ???
My view 'scope to extend' is enough

Estate agents should be consulted, and their advice followed. A very posh area might be exactly the sort of place where planning is difficult to get. What you can do is get an uplift agreement: if the buyers get, eg. planning permission to build a new house and sell it within a given period, say 10 years, then they have to pay a further sum, usually calculated by reference to the 'uplift' in value of the property and the number of years since the sale, and an undertaking to impose a similar condition on any purchaser. That way, if the buyers or anybody who buys subsequently never do anything, there's nothing extra to pay; if they do, the sellers get a nice bonus. (Not often done unless there are very large sums involved due to the legal costs. Hoorah! Lawyers make more money!)

I was once a planning officer and the yes or no depends on - will the new structure fit in with the existing building, overlooking, trees, 45 degree daylight veiw and lots of other things.
It does not matter where or how posh the road is.
If you want to build 15 percent or less of the origional, you do not need planning but do need to work with the local building inspector.
Saying this - with the market the way it is, a financial adviser would prob advise against an extention as you may not make your money back.
A typical 1950's 3 bed semi. To build a two story extention the full length of the house and 4M wide in the Leicestershire area would set you back £70000. This would be a low spec development and would include building costs only.

What I was thinking was for them to get the Outline PP really (what S38 means by "scope"?)in order to up the value of the house. But sell before building as that would be expensive.
I heard of someone doing that and getting more money for their property.

if you don't actually go ahead with the building , you'd probably only break even.

The answer is no its not worth getting the plans done before you put it on the market.
Its only my opinion having been in that situation but get your friends to ask their or several estate agents
They will say 'potential' to extend etc subject to planning permission
so re my house you might get permission to extend and add a room but not build a working car garage or turn it into B&B etc

Not in Scotland - Scottish Building Regulations are issued by the Scottish Executive, policed by the local council and cover all aspects of construction: ie the How it's built.
Planning Permission is a local council thing that is to do with the asthetics of where it is built and who you could upset by building it.
Both are different, and you need both before you can build. "Outline" planning is basically a formal way of the planners saying "yea, should be OK - I'll let you know when you put in the final plans".
I would recommed talking with the local planning department at the council and an estate agent. (I would also recommend steering clear of Architects unless you want something completley unique and/or a large hole in your bank account)

You are correct, i asumed we were talking England as this is where i live (must remember - Ceroc Scotland forum)
However, the wife and i have just sold our house. We marketed it last year for X amount to no avail. We marketed it again 6 weeks ago with approved planning permition and sold it for an extra £30000.
I can honestly say it didnt cost us £30000 to get plans appoved.

:D Planning permission isn't that hard to get - just need to get some plans drawn up that are 'in keeping' with the existing and don't annoy any neighbours. The actual fee to the council is a fixed fee, it's the design and drawing fees that will reduce you by an arm or so.
Building Warrant is a pain in the butt. Asside from being on a sliding scale of fees from the council, there are so many rules and regulations about every aspect you can think on from density of the concrete blocks to daylight and ventilation to insulation and heating to electrics and plumbing... get a specialist in to do this or form a really close relationship with the building inspector.
But you only need this when you actually want to build it- they check at various stages of the build and once it's complete sign off a "completion certificate" to say that it's all OK. You need this bit of paper before you can sell your house with the alterations.
(Oh, and sometimes what Planning say you must have, Warrant say you can't have... and what Warrant say you must do, Planning say you can't... :rolleyes: )
